TERMS OF SERVICE

 

1:a: IMPORTANT: Order cancellations, credit for damaged items or any further reason for cancellation or credit is refunded via Snaks 5th Avenchew store credit and given in the form of a Snaks 5th Avenchew E-Gift Card that can be used at any time without expiration. Snaks 5th Avenchew does not issue store credit for the original shipping charges for any reason, at any time.

1:b: PRODUCTION & FULFILLMENT TIMES:

  • We cannot guarantee an order will arrive by a specific date, holiday, event or occasion...for any reason. Please do not assume it will. 
  • If your order is cancelled after your order is placed, you will receive a 100% full store credit to use at a later date, without expiration.
  • If you would like a refund to your original payment method, you will be charged a production fee that is 25% of your order value and the remaining balance will be refunded to your original payment method.

2:a: REFUND TERMS: STORE CREDIT ONLY.

2:b: ALL custom orders are required to be paid in full before production begins. Orders without payment will not go into production. This will also delay your ship date. Custom Orders are not eligible for cancellation. Should an order be cancelled during production. 50% of your total order value will be credited in the form of an E-Gift Card.

3:a: Returned-to-Sender & Refused Packages

  • This can happen if (1) an address is invalid or missing information, (2) the carrier is unable to deliver your package, or (3) the order is refused by the customer at time of delivery.
  • Returned-to-Sender or Refused packages will be restocked and you will be issued store credit in the form of an E-Gift Card minus the initial shipping charge.
  • We are unable to make changes to orders once they have been picked up by the carrier. To ensure that your package is properly delivered, make sure that your address is entered correctly and includes all relevant information. The use of correct abbreviations, street numbers, building or apartment numbers, and route information (if applicable) are critical to ensuring delivery.
  • We do not take responsibility for lost, misplaced, or incorrectly delivered shipments if the address information provided is incorrect at the time of purchase. Please contact the carrier associated with your tracking number.

4:a: SALE ITEMS TERMS:

  • ALL SALES ITEMS ARE FINAL.
  • NO REFUNDS, NO RETURNS. STORE CREDIT ONLY!!!

5:a: EXCHANGE TERMS:

  • For the health and safety of our customers, no returns or exchanges.

7:a: CLAIMS & REPORTED ISSUES

  • Customers have 48 hours from the time an order is received to report any issues. ONLY Store Credit in the form of an E-Gift Card will be given, minus the initial shipping charge. 
  • Please be sure to submit photos with your email so that we can file your claim appropriately.
  • Filing a claim does not guarantee a credit.
  • Any reported issues after 48hrs from the time you receive your order will not be valid.
  • ONLY Store Credit in the form of an E-Gift Card will be given, minus the initial shipping charge.
  • During a claim the customer will be responsible to cover any and all shipping costs.

8:a: SNAKS APPAREL & SADDLE PADS

  • Returned items must be unworn and unwashed (free of any stains from makeup, deodorant, or wear) with all Snaks 5th Avenchew and product tags/labels attached. For Saddle Pads and any horse-wear, Returned Items must be unused and unwashed (free of any stains, hair, dirt, slobber, sprays or wear) with all Snaks 5th Avenchew and product tags/labels attached.
  • Defective items must be reported within 2 days of receipt for consideration. If not reported, we will not be able to review for a possible issue of store credit minus the initial shipping charge. If you believe you have received an incorrect item, please contact us within 24 hours of receiving your package.
  • We recommend shipping packages back using USPS Flat Rate shipping with a tracking number, as we are not responsible for lost packages or stolen packages. Without proof of receipt and delivery, Snaks 5th Avenchew will not issue store credit. 

9:a: RESERVED RIGHTS

      • Snaks 5th Avenchew reserves the right to refuse business.
      • Snaks 5th Avenchew has the right to solely define and limit, refuse, and/or reject returns or service from customers at any time due to:
      • An irregular or excessive returns and/or cancellation history indicative of “wardrobing” for horse or rider.
      • An irregular or excessive returns and or cancellation history involving worn, altered, laundered, damaged, or missing items; or,
      • Potential fraudulent or criminal activity.
      • An irregular or excessive history of ongoing complaints, reported delivery issues,  without accepting resolution within the Terms & Conditions of Snaks 5th Avenchew, excessive chargeback history, Oral Defamation, or has been in violation of the listed Terms & Conditions.
      • Snaks 5th Avenchew reserves the right to refuse business and serve customers who continue to exercise the following (but not limited to: Oral Defamation, unreasonable demands, does not honor Snaks 5th Avenchew Policies and Terms and Conditions, or if a customer is abrupt, rude and uncooperative toward Customer Service employees.
  • 9:b: Similarly, Snaks 5th Avenchew reserves the right to refuse service (both in-booth and online) to any customer or entity, due to similar actions as noted above as seen fit. 
  • 9:c: Non-Snaks 5th Avenchew items sent to our distribution center will be discarded upon receipt.

10:a: RESERVED RIGHTS

  • Snaks 5th Avenchew reserves the right to solely define and limit, refuse, and/or reject returns or service from customers at any time due to the below mentioned:
  • Our Customer Protection Team also handles situations in which a #Snakaholics return history may be indicative of fraudulent activity or purposeful damaging. In these situations, the Customer Protection Team will reach out to discuss the situation and work with you to either resolve the issue or determine if we need to refuse service going forward. While we never want to reject a #Snakholic, we must ensure the safety, welfare, and comfort of all #Snakaholics and their fur-babies across the globe. 

10:c: RESERVED RIGHTS REGARDING EXCESSIVE CLAIMS & CHARGEBACKS

  • Snaks 5th Avenchew reserves the right to solely define and limit, refuse, and/or reject returns or service from customers at any time due to the below mentioned:
  • Our Customer Protection Team also handles situations in which a #Snakaholics chargeback history may be indicative of fraudulent activity or purposeful filing false chargebacks with their credit card company. In these situations, the Customer Protection Team will reach out to discuss the situation and work with you to either resolve the issue or determine if we need to refuse service going forward. If the chargeback(s) cannot be resolved between Snaks 5th Avenchew Customer Protection Team and the Customer, and a response must be submitted to the credit card company by Snaks 5th Avenchew, our Customer Protection Team will then determine if we need to refuse service going forward.
  • Snaks 5th Avenchew also has the right to refuse service going forward, prior to receiving a final decision from any bank or credit card company that is currently reviewing a chargeback submitted by the customer. 
  • While we never want to reject a customer, we must ensure the safety, welfare, and comfort of all customer and their fur-babies across the globe. 

11:a: RETURN BY MAIL

  • Please contact Snaks 5th Avenchew immediately for your Return Form if approved. Print and fill out our return slip or include your original packing slip with the item(s) being returned. Please note that without including your order number on the returns slip or with your returned item(s) there may be a delay in processing your E-Gift Card Store Credit return, minus the initial shipping charge.
  • Pack your item(s) securely in the original product packaging, if possible. All items must be returned in original condition (including all paperwork, packaging, and accessories) with tags attached. All items must be unworn (by horse and/or rider, unaltered and unwashed. We do not accept returns on any and all edible items, PopSockets, Subscriptions, Phone Cases, Socks or final sale items (those items ending in $.94, $.96, $.97, $.98 or $.99).
  • All return shipping charges must be prepaid. We do not accept COD deliveries; they will be rejected. We recommend sending your return via USPS Flat Rate with a tracking number and insurance, as we are not responsible for lost or stolen packages.

12:a: CREDIT

  • Damages must be reported within 48hrs from the time your order is delivered for consideration.
  • Photos are required and must be submitted with your email for a claim to be opened. Please include your order number.
  • Should your claim be approved, you will receive a store credit for your damages value to use at a later date, without expiration.

  • Store credit via E-Gift Card for your returned item(s) will be processed once they are received at our distribution center, minus the initial shipping charge
  • Please allow 5-7 days to process your return once it is received into our distribution center. 
  • Your E-gift card (minus the initial shipping charge) covers the original purchase price and tax if applicable. Snaks 5th Avenchew does not credit shipping charges.

13:a: STALE RETURNS

  • Snaks 5th Avenchew requires items to be returned within 15 days of original receipt. Returns received in our distribution center or in-booth retail locations after 15 days are considered stale returns. Stale returns by mail are subject to being rejected and returned the sender. Alternatively, if the cost returning the item to your attention exceeds the then current value of the item, Snaks 5th Avenchew will apply a 50% restocking fee to the item(s) when processed in our distribution center. An E-Gift Card for the remaining balance will be issued following our normal returns process. Minus the initial shipping charge
  • Stale returns or any returns in our Horse Show in-booth retail locations are prohibited.

13:b: STALE ORDERS

  • If there is an issue with your order or address, we will contact you.
  • Snaks 5th Avenchew requires orders to be claimed within 15 days of initial email sent. (3) attempts will be made.
  • If an order goes unclaimed, for more than 3 failed attempts, your order will be cancelled and the value will be given back to you in the form of a Store Credit.

14:a: SUBSCRIPTIONS

  • Any and all SnakBox subscriptions are sent out (on or about) the 15th of each month. Should the 15th of any month fall on a weekend or holiday, the subscription box will ship out the following business day. To be eligible for any subscription, orders must be placed on or before the 5th of each month. Subscriptions cannot be returned.
  • Subscriptions must be ordered from the 1st of the month through the 30th of the month. Any orders placed on the 31st or the following month is considered after the cutoff and will process for the following month.

15:a: SHELF LIFE

  • Because our Snaks are made without any preservatives, if stored properly in a cool dry place, our Snaks can last up to 15 months. Snaks 5th Avenchew is not responsible for items that are not used within this time-frame.

16:a: DAMAGED ITEMS

  • YOU HAVE 48HRS FROM THE TIME YOUR PACKAGE IS DELIVERED TO REPORT ANY DAMAGE VIA EMAIL (s5awholesal.com). Please enter CLAIMS/DAMAGE along with your order number in the subject line. This email MUST include a photo of your damaged product for our Claims Dept to review.
  • Claim reviews do not guarantee a credit or replacement.
  • Final decisions will be up to Snaks 5th Avenchew LLC Management. If a replacement is granted, customer may endure additional shipping fees.
